DESPERATE AUSTRALIANS fleeing the peril of those floating petri dishes of hell like the Ruby Princess are now finding themselves thrust face-first into 14 days of mandatory quarantine at some of Australia’s finest 5 star hotels.
However, the picture is far from rosy, with many of these new-found “guests” reporting prison-like conditions, disgusting food, and staff who treat them “like criminals.”
“It’s a living hellhole,” said Felicity Purdue-Smythe, 62 of Mosman, NSW.
“We had just arrived back from our annual skiing trip in Aspen to suffer the indignity of being transported in ‘a bus’ to the Intercontinental Hotel at Circular Quay, only to find that our regular suite had been allocated to other travellers.”

The High Court did itself and Australian justice a great service by finding for Pell. The legal point was simple enough – if the defence witnesses give unchallenged evidence which raises a reasonable doubt as to the defendant’s guilt then the jury must acquit. That is what ‘beyond reasonable doubt’ means.
Once a doubt is raised it is for the prosecution to prove that it is not a reasonable doubt. In this case multiple witnesses gave evidence that raised a reasonable doubt. The evidence was not challenged by the prosecution. Thus the prosecution did not come close to proving that there was no reasonable doubt.
If you care about the presumption of innocence there was no other decision than acquittal. This was clear enough to anyone who read Weinberg’s dissent in the Court of Appeal. This decision is a great victory for the presumption of innocence.
Of course anti-Catholic bigots everywhere will still believe Pell did it. I believe he didn’t but that is something reasonable people can disagree on. I am all for driving perverts out of the Church. I just don’t think Pell is one of them.
Also the two judges who upheld the conviction in the Court of Appeal were Catholics. Sadly there were also ignoramuses. A seven nil smackdown by the High Court is not a trivial thing.

How a selection of elite judges can find the decision of a jury of a persons peers as being wrong simply amazes me. Why have juries at all then? Why not just a bunch of judges sit on every trial in the land. If the high court can overrule a jury then the jury system is totally obsolete. Our legal system is broken. A jury is selected from a random panel of citizens, with the defence able to scruitinise those selected for the jury, with a number of rejections given to both the defence and the prosecution until the actual jury is selected. To then have either side appeal to a court full of judges to then override the whole process is an abomination. The jury did NOT entertain a doubt as a jury must be unanimous in its decision. To have a few judges throw out a jury unanimous decision is simply wrong.

The decision of the High Court was a victory for justice. Those who would like to see Pell convicted so as to not discourage victims from coming forward are disgustingly vile pieces of shit. He should be convicted if the prosecution proved beyond reasonable doubt that he committed the crime.
In this case the prosecution abjectly failed to do so. It was always impossible that they would be able to do so based on uncorroborated statements of the victim. And it would be disgraceful if our legal system permitted such convictions to stand.
The High Court has not made new law here. It has applied existing law. The relevant cases are cited in the judgment.
Finally, the High Court should be composed of the intellectual elite. The idea is that it should be populated by the best and the brightest members of the legal profession. This is usually the case. The rare exceptions are the relatively few examples of ALP cronyism such as the appointment of the execrable Lionel Murphy.
There were 33 new cases in Victoria yesterday bringing the cumulative total to 1191. Take away 11 who have died and 686 who’ve recovered, means there are 494 currently sick with the virus. No! Supervision of juries is part of our judicial system. Appellate courts are reluctant to overturn jury decisions but will do so where the decision of the jury is unsafe because no rational jury could make that decision. This is all explained in the judgment.
If jury decisions were not subject to appellate review then there would be no avenue for a wrongly convicted defendant to have his conviction reviewed. This would be seriously unjust. In almost every successful appeal against a conviction for serious crimes a jury verdict is overturned. Apparently you want to terminate the right of a convicted person to appeal.
In this case no rational jury could come to the decision that the prosecution had proved its case beyond reasonable doubt. This will inevitably be the case were there is no evidence whatsoever to corroborate the victims narrative and there is unchallenged evidence that the defendant was not able to have committed the offence as charged. It is right and proper that the HIgh Court exercised its power to overturn the conviction.
In our system it is likely that some guilty people will escape conviction. Blackstone, one of the most influential jurists in the Anglo legal tradition, famously said: “It is better that ten guilty persons escape than that one innocent suffer.”

Retardland, if the prosecution presents only the uncorroborated (vague) word of the (alleged) victim it is difficult to see how it could ever succeed in proving something beyond reasonable doubt.
It is no surprise that the High Court found as it did. This is a particularly strong bench. My favourites are Gageler and Gordon but the rest are very capable as well.

Upshot … whenever there was contention in the court over a legal point … jurors were asked by the judge to adjourn to the jury room …
FYI, in both cases the defendant was found not guilty …

All came crashing down in 1970, I was called up – two years repairing armoured vehicles and playing soldier … $80 a fortnight – from $140 a week to $40 … both careers suffered pretty badly – couldn’t sing during NS against the rules – and I had to return to overalls …

I don’t attempt it. I like to go to pub Karaoke nights and just watch the proceedings – from those who rehearse and sing there hearts out to tuneless drunks.
Before the singing starts there are, among the more jovial drinkers, a few people sitting alone, looking a bit tense. They’ve obviously rehearsed and are a pretty good standard. They finish their chosen song, look relieved and usually get a pat on the back and a comment from their peers. I love listening to apparently shy people fully invested in their music getting up to sing their hearts out in public. I think it is a beautiful thing to watch. I love singers and songs. It is a rare night that I don’t hear some great singing, some emotional songs and some great songs that had fallen off my radar.
When I left my previous job I requested farewell drinks be a karaoke night. Luckily a few workmates had good voices.
I DJ reggae music on vinyl once a week at a small bar (when I’m not in corona virus lock down). I do it for beer and pizza. I’m not a great DJ but this is great recreation for me. If go to my turntables at home and try to play reggae for four hours straight – it ain’t going to happen.

It’s getting a pretty good work out actually. I used to work from home a few years ago, and did realize how much I missed it. Work is about 1.2hrs each way normally, so I now have some spare time. We also try to get down the beach regularly to, for our 10 minute wade. Which, to be fair, is all we really used to do anyways, so, not much of a change for us lol

There is one apparent anomaly when comparing national virus stats with those of Victoria. The percentage of total cases classed as ‘recovered’ in Victoria is around 87.5%. Nationally it’s about 57%. (NSW doesn’t publish ‘recovered’ numbers so I can’t check their figures.) Most curious.

That’s why we moved to this very high level of restriction, or have you forgotten the rationale?
Now that we’re a long way from that point, it’s time to acknowledge that a different set of restrictions are appropriate. Restrictions that protect the welfare of those most vulnerable, but allow everyone else to start to rebuild their lives.
The sooner people can have a sense that they are over the worst (and we are) the better for everyone.
